DMCA Policy
This DMCA Policy describes how Noah's Tutoring Hub handles copyright complaints, repeat infringement matters, and counter-notices under the Digital Millennium Copyright Act ("DMCA"), including 17 U.S.C. § 512.
1. Submission Channel
DMCA notices and counter-notices must be submitted through our official Discord support system by opening a ticket. Our Discord server is available at discord.gg/pCGQ8vrKza. We may decline to process informal social DMs, incomplete messages, or complaints sent through channels that do not reasonably allow us to verify and track the request.
2. Required Elements of a DMCA Notice
To submit a copyright complaint, please open a Discord ticket and include all information reasonably necessary for compliance with 17 U.S.C. § 512(c)(3), including:
- Your full legal name and sufficient contact information.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
3. Review and Response
Upon receipt of a facially valid notice, we may investigate the claim, remove or disable access to the challenged material, request additional information, notify the affected user or content source where appropriate, and take any other step we deem reasonably necessary to address the complaint, protect rights, or comply with law.
4. Counter-Notification
If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notice through a Discord ticket. A valid counter-notice should include the information required under 17 U.S.C. § 512(g), including your contact details, identification of the material removed, a statement under penalty of perjury that the material was removed as a result of mistake or misidentification, your consent to the jurisdiction of the appropriate federal court where required by law, and your physical or electronic signature.
5. Repeat Infringers
Where appropriate and in our discretion, we may terminate, restrict, or refuse access to users, submitters, or content sources that are the subject of repeated, abusive, or bad-faith infringement complaints or other intellectual property violations.
6. Misrepresentation
Submitting a knowingly false notice or counter-notice may expose the submitting party to liability, including liability under 17 U.S.C. § 512(f). You should review your claim carefully before submitting it.
